Terms of Service

1. Services

PromptSwing provides SaaS tools for ecommerce merchants including abandoned cart recovery, customer review management, revenue intelligence diagnostics, and commerce belief governance. Services are provided on a subscription basis.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate registration information. PromptSwing reserves the right to suspend accounts that violate these terms or engage in fraudulent activity.

3. Subscriptions, Prepaid Time and Billing

Subscriptions are billed monthly in advance. Payments are processed by Paddle, who acts as Merchant of Record. By subscribing, you authorize Paddle to charge your payment method on a recurring basis until you cancel.

Prepaid time. An AI assistant you have connected to your PromptSwing account, with your permission to buy for it, may buy thirty days of a plan at the published price. You approve each purchase yourself, in your own payment wallet; the assistant cannot approve it for you. Prepaid time is paid once, does not renew, and no card is kept. It starts when bought, or when prepaid time you already hold on the same plan ends. It cannot be bought for a plan your subscription already covers. For these purchases Bergen Ridge LLC is the seller of record, and payment is processed by Stripe.

Build allowance: each store includes its first build plus one new build. Builds do not renew. After that, a store is changed by revisions.

4. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the service until that date. A hosted store is then taken offline and kept as described in section 5.

5. Hosted Stores: Unpaid Plans, Suspension and Removal

A store is served only while a plan that includes hosting is paid.

• Reminders. Before prepaid time ends, we email you seven, four and one day before its end date. If a subscription payment fails, we email you once, with the date your store will go offline.
• Offline after three days. If a subscription payment is not settled, or prepaid time ends without more being bought, your store goes offline three days after the payment was due. We email you when it does.
• Cancellation. If you cancel, your store goes offline when the cancellation takes effect.
• Kept for 90 days. While your store is offline, its files, published versions and data are kept for 90 days.
• Coming back. If you pay again within those 90 days — by settling the payment, subscribing again, or buying prepaid time — your store comes back online, normally within one day.
• Suspending your own store. If you suspend your store yourself, it stays offline until you resume it from your dashboard. Resuming requires a paid plan that includes hosting.
• After 90 days. After 90 days offline, your store's served files, published versions and build history are permanently deleted, and this cannot be undone. We email you at 60 days and again the day before. Your account, orders and records are kept. If you then pay again and build, it is a new store, with its own build allowance.

6. Acceptable Use

You may not use PromptSwing services to send unsolicited communications, violate applicable law, infringe third-party rights, or interfere with the platform infrastructure. Each app operates under a single-contact consent doctrine — one message per customer event, no campaigns, no follow-up sequences.

7. Data

Your data belongs to you. PromptSwing processes merchant and order data only to deliver the services you have enabled. We do not sell data to third parties. See our Privacy Policy for full details.

8. Limitation of Liability

PromptSwing provides diagnostic and intelligence services. Outputs are informational and do not constitute financial, legal, or business advice. PromptSwing is not liable for decisions made based on platform outputs. Our liability is limited to the amount paid in the 30 days preceding any claim.

9. Changes to These Terms

We may update these terms with reasonable notice. Continued use of the service after changes constitutes acceptance. Updates will be posted at promptswing.com/terms.
